FATIMA OMORO AKINBAMI, J.C.A. (Delivering the Lead Ruling): By a motion filed on 23rd September, 2021, learned counsel for Appellant/Applicant seeks the

following reliefs:

1. AN ORDER of this honorable Court dismissing the Appellant/Respondent's appeal against the judgment of the High Court, Taraba State delivered by Honourable Justice F. B. Andetur on the 30th of April, 2018 in suit No. TRSJ/73/2017 for want of diligent prosecution.

2. And for such further or other orders as this honorable Court may deem fit to make in the circumstances.

THE GROUNDS UPON WHICH THE APPLICATION RESTED IS STATED THUS:

i. The 60 days period prescribed in the rules of this honorable Court for the Registrar to compile the record of appeal expired, in 4th September, 2018 and the additional 30 days period for the counsel for the Appellant also expired in 5th October, 2018 and there is no record of, appeal nor application by the Respondent to regularize their position.
