JOSEPH OLUBUNMI KAYODE OYEWOLE, JCA (Delivering the Leading Judgment): This is in respect of an appeal against the judgment of the High Court of the Federal Capital Territory, Abuja Judicial Division, sitting in Jabi, Abuja delivered on the 19th February, 2019 by D. Z. SENCHI, J (now JCA).

The 1st and 2nd Respondents took out a writ of summons against the Appellant and the 3rd Respondent at the lower court wherein they sought the following reliefs:

1. A declaration that the 1st Plaintiff is the allottee and the holder of title and interest in the property known as Plot No. 1049, 64 Crescent C-close Gwarimpa II estate Abuja covered by Federal Housing Authority “ALLOCATION FOR A RESIDENTIAL PLOT OF LAND AT GWARIMPA II ESTATE ABUJA dated the 12th day of September 2013.
