MOHAMMED BABA IDRIS, J.S.C. (Delivering the Leading Judgment): This is an appeal against the judgment of the Sokoto Division of the Court of Appeal in Appeal No. CA/S/80/2012 delivered on the 20th day of June, 2013, coram: Tijjani Abdullahi, JCA, Tunde O. Awotoye, JCA, James S. Abiriyi, JCA. The Court of Appeal, in part, affirmed the judgment of the High Court of Sokoto State in Suit No. SS/69/2010, delivered on the 30th day of March, 2012 by the Honourable Justice Bello Abbas, sitting at the Sokoto Judicial Division wherein the trial High Court granted all the reliefs sought by the appellant at the trial stage.
By a writ of summons and statement of claim dated and filed on the 1st day of November, 2010, the appellant, as plaintiff before the trial court, instituted an action against the respondent, who was the defendant at the trial court and sought for the following reliefs:
