MUHAMMED ABDULLAHI V. THE STATE

MOORE ASEIMO ABRAHAM ADUMEIN, J.S.C. (Delivering the Lead Judgment): The appellant was the 1st accused defendant in Suit No: SS/42C/2013 initiated by the respondent in the High Court of Sokoto State, holden at Sokoto. One Safiya Umaru was the 2nd defendant. They were charged as follows:

"That you Muhammadu Abdullahi and Safiya Umaru of Ambarura village Illela Local Government on or about the 29th day of June 2012 at about 2300 hours at Ambarura village of Illela Local Government of Sokoto State within the Sokoto Judicial Division agreed to do an illegal act to wit cause the death of a new born girl child and the same act done in pursuance of the agreement and that you thereby committed an offence punishable under Section 97 of the Penal Code.
