NONYEREM OKORONKWO, J.C.A. (Delivering the Leading Judgment):The appellants in this appeal were claimants at the High Court of Ogun State wherein by their amended statement of claim, the following declarations and orders were sought against the respondents who therein were defendants;

1. A DECLARATION that the 9 Plots of land situate, lying and being at Temidire Ota, Ogun State and more particularly delineated and described in Survey Plan to be filed in this Suit is the Family property of ABOLEJA of OLUNLOYE FAMILY of IGA MUGBA COMPOUND only.

2. A DECLARATION that the 9 Plots of land situate, lying and being at Temidire Ota, Ogun State and more particularly all that vast parcels of land delineated in Survey Plan No. AB/7766 drawn by Surveyor ADIO APATIRA dated 6th of July, 1972 and redrawn on Surveyor Plan No. S.O.
