ABUBAKAR YUSIF V. FOREWIN GHANA LIMITED

JUDGMENT

The plaintiff issued out Writ of Summons against the defendant on 26^th March, 2009 for the following reliefs:

1. a declaration that plaintiff’s appointment was wrongfully terminated;

2. three month’s salary for each year plaintiff has served as an employee of the defendant company and any other outstanding benefits as per the collective bargaining agreement;

3. damages for wrongful termination of his appointment; and

4. costs.

The defendant entered appearance on 15^th May, 2009 and went on to file his Statement of Defence on 26^th May, 2009.

After pleadings had closed, the Court set down the following issues for trial on 19^th August, 2009:

a. Whether or not plaintiff’s employment was wrongly terminated;

b. Whether or not plaintiff is entitled to his claim; and

c. Any other issues arising out of the pleadings.

Plaintiff’s case is that he was employed by the defendant on 12^th December, 1994 and his appointment was terminated on 16^th September, 2008. He, therefore, worked with the defendant …
