(Delivering the Leading Judgment): The respondent as claimant at the National Industrial Court of Nigeria, Port Harcourt instituted an action against the appellants as defendants on 28/9/2017 claiming the total sum of N2,774,560.00 (Two Million, Seven Hundred and Seventy-Four Thousand Five Hundred and Sixty Naira) only made up as follows: 

1. Salary arrears for 21 months x N100,000.00 = N2,100,000.00 

2. Commission for JAMB Payment: N2,191, 200.00 x 5% = N109,560.00 

3. Commission for Noun Payment N10,500 x 5% = N525,000.00 

4. Commission for Lulu Briggs Foundation Payment N40,000.00. 

The defendants/appellants upon being served with the claimants/respondent’s claim, filed a memorandum of appearance and statement of defence and counter-claim on the 16th of January, 2018.
