Judgement

JUDGMENT 

The Plaintiff, Adams Azango Yahaya, acting by his Lawful Attorney, Ben Adams, caused a  writ to be issued against the Defendant, Bright Kofi Baah, for the following reliefs; 

1. A declaration that the conversion of the block on the leased land into a two-storey  building without recourse to Plaintiff is a breach of the lease agreement executed  on 30th January, 2003. 

2. General damages for the breach of the lease agreement. 

3. Perpetual injunction restraining the Defendant, his servants, workmen, agents  and all those claiming through him from carrying on with the construction works  on the land. 

4. Alternatively, an order compelling the parties to renegotiate the terms of the lease  agreement concerning the two (2) floors Defendant is erecting on the existing  block. 

In the accompanying statement of claim, the Plaintiff averred that he is the beneficial owner  of a parcel of land situate at New Town in Accra. He claims that by a lease dated 30th January,  2003, he leased out …
