<p>TIJJANI ABDULLAHI, J.C.A. (Delivering the leading : ): The Appellant was arraigned and tried for the offence of Culpable Homicide contrary to Section 221 (b) of the Penal Code by the Taraba State High Court of Justice, Coram Ali I. Adenyangtso (J). On the 20th day of May, 2015, he was found guilty and convicted. The charge for which he stood trial reads thus:</p><p> "That you Gidado Adamu on or about the 30th day of September 2011, at about 1900hrs at Namnai Village in Gossal Local Government Area within the Jalingo Judicial Division committed an offence to wit: You stabbed one Shuaibu Ahmed with a knife on his right ribs with knowledge that death would be the probable and not only a likely consequence of the act and he was rushed to Cottage Hospital, Mutum Biyu where he died on admission".</p><p> When the charge was read to the Appellant he pleaded not guilty.
