IKYEGH JCA (Delivering the Lead Judgment): The appeal is from the judgment of the High Court of Justice of Lagos State (the court below), striking out the appellant’s action on ground of lack of locus standi with respect to the demolition of their two storey school building located at No. 12, Supo Adigun Street, Off Ligali Street, along Lagos-Ibadan Expressway, Ori-Oke, Ogudu, Lagos.

Reduced to material facts, the dispute that led to the litigation disclosed that the appellants are bona fide students of Sceptre Comprehensive College, a secondary school duly approved as an educational institution by the Lagos State Ministry of Education, the school had been operational on the approved standard by the Ministry of Education, Lagos State; then on 10 July 2008, while the appellants and the school officials were in the school, agents of the respondents drove earthmoving machines and demolished the two storey building; the demolition was done while the appellants were writing their West…
