OKUNOLA JCA (Delivering the Lead Judgment): This is an appeal against the judgment of P. O. Aderemi J. sitting at the High Court of Justice, Oyo, delivered on 22nd April, 1998. The facts of this case briefly put were as follows:

The plaintiff/respondent’s claims against the defendants/appellants at the High Court, Oyo were as follows:

“(a) Declaration that it is unfair and a gross violation of the principle of natural justice for the 1st defendant to act as the kingmaker and the prescribed authority in the matter of the nomination, selection, appointment and conferment of Chief Agunpopo of Oyo Chieftaincy on the 2nd defendant ; Declaration that the 2nd defendant not being a member of any of the ruling houses of Chief Agunpopo of Oyo Chieftaincy nor a person so nominated for appointment to the said chieftaincy by members of Falade family/ruling house cannot lawfully hold the title of Chief Agunpopo of Oyo ; Declaration that the purported appointment and or conferment of the title of Ch…
