MOHAMMED BABA IDRIS, J.S.C. (Delivering the Lead Ruling): This is a Motion on Notice brought pursuant to Order 2 Rule 31, Order 7 Rule 7(2) of the Supreme Court Rules 2014 (as amended), Section 36(1) of the Constitution of the Federal Republic of Nigeria, 1999 (as amended) and under the inherent powers of this Court, praying for the following orders 

  1. AN ORDER of this Honourable Court granting leave to the 1st Respondent/Applicant in Appeal No: SC291/2017between Captain M. B. Gowon v. Tokunbo. A. Adeyemi & Anor to compile and transmit Supplementary record of appeal from the lower Court appeal (Court of Appeal, Abuja Division) in Appeal No. CA/A/36A/2011 to this Honourable Court out of time. 

  2. AN ORDER of this Honourable Court deeming the Supplementary record of appeal already compiled and transmitted by the 1st Respondent/App/icant in Appeal No: SC 291/2017 between Captain M. B.
