MBABA JCA (Delivering the Lead Judgment): This is an appeal against the judgment of Adamawa State High Court in suit No. ADSY /82/ 92, delivered on 24 March 1999 by T. Oluoti, J.Appellants filed their notice of appeal on 23 June 1999, complaining against the whole decision and raising six (6) grounds of Appeal. At the lower court the appellants were defendants in the suit brought by writ of summons wherein the plaintiff (now respondent) claimed as follows, as per his amended statement of claim.
