Judgement

CHIOMA EGONDU NWOSU-IHEME, J.S.C. (DELIVERING THE LEADING JUDGEMENT): This appeal is against that part of the judgment of the Court of Appeal, Lagos Division coram Ogbuinya, with Bayero and Affen, JJCA delivered on 27/06/2022 in Appeal No. CA/L/1120/2011 -CENTRAL BANK OF NIGERIA V. AFRIBANK NIGERIA PLC & ORS, wherein the lower Court held that the Federal High Court, Lagos Division ("the trial Court") lacked jurisdiction to hear the suit as it did, struck out the suit and the Respondent's Notice of Intention to Contend and also set aside the ruling of the Federal High Court, Lagos coram Hon. Justice James Tsoho delivered on 15/04/2011. 

STATEMENT OF FACTS

The Appellants commenced the suit, subject of the appeal via an Originating Summons filed on 13/11/2009 praying the trial Federal High Court to grant the several declaratory, mandatory and injunctive reliefs contained in the Originating Summons.
