Judgement

ADEBUKUNOLA ADEOTI IBIRONKE BANJOKO, J.C.A. (Delivering the Leading Judgment): This is an appeal against the Judgment delivered by Honorable Justice R.O. OLORUNFEMI of Kogi State High Court on the 27th day of February, 2020 in Suit No: HCL/53/2019 as seen at pages 529-556 of the record of appeal. It is pertinent at the outset to state that this is a sister appeal to Appeal No: CA/ABJ/CV/330/2020 and Appeal No: CA/ABJ/CV/332/2020. The facts and circumstances in all these three appeals arose out of the ONE judgment in suit No: HCL/53/2019.

The issues raised in the three appeals are similar, therefore, the determination of identically raised Issues in Appeal NO: CA/ABJ/330/2020, and Appeal NO: CA/ABJ/331/2020 would be adopted in this judgment and would abide the decisions arrived at in Appeals NO: CA/ABJ/330/2020 and CA/ABJ/331/2020.

This instant appeal would therefore only treat issues not arising from the common issues in Appeal No: CA/ABJ/330/2020 and Appeal No: CA/ABJ/331/2020.
