HELEN MORONKEJI OGUNWUMIJU, J.C.A. (Delivering the Leading Judgment): This is an appeal against the judgment of the High Court of Justice, Anambra State, Anambra Judicial Division, delivered by Hon. Justice J. I. Nweze on 26/6/2012.
The facts that led to this appeal are as follows:-
The subject matter of the suit at the trial Court is a parcel of land situate at Enuovuve Layout Phase 111, Nkwelle-Ezunaka Oyi Local Government Area of Anambra State. The Appellant as Defendant at the trial Court claimed to have purchased the land in dispute from one late Isaac Ibemesi Beluchukwu who was the husband of the 1st Respondent (1st Defendant at trial) and father of the 2nd - 5th Respondents (2nd - 5th Plaintiffs at the trial Court). The Respondents sold the land to one Johnmalaki Okoye and the Appellant challenged the title of the Respondents as well as the sale to the third party.
