MR. SAMUEL AHANONU V. MRS. RAYMOND CHRISTOPHER CHUKWUEMEZIE

OBASEKI-ADEJUMO JCA (Delivering the Lead Judgment): This is an appeal against the judgment of Olateru-Olagbegi J., of the High Court of Lagos State, delivered on 29 October 2013, wherein he entered judgment for the respondent herein.

The suit at the lower court was commenced by writ of summons and statement of claim dated 19 November 2007, wherein the respondent claimed the following reliefs:

“1. A declaration that the forceful eviction from his premises at No. 8, Odiche Street, Coker Village, Lagos by the defendant is unlawful, null and void and a violation of his right to peaceful enjoyment of his tenancy and family life.

2. A declaration that the unlawful eviction of the claimant and his wife from their lawfully rented apartment has occasioned great hardship and inconveniences.

3. A declaration that the forceful eviction of the claimant and his wife from the lawfully rented apartment is a violation of their right to family life.
