MUHAMMAD JCA (Delivering the Lead Judgment): This is yet another interlocutory appeal from the decision of the Federal High Court, sitting in Lagos. Such appeals, sadly, are a common feature on our judicial landscape, particularly in the Lagos area. They impact very negatively on the justice delivery system. The constitutional right to such appeals accounts in substantial measure for avoidable delays which wantonly characterise the terrain. Suit FHC/L/C/P/103/98 commenced in the name of the respondent herein, by the Nigerian Deposit Insurance Corporation (N.D.I.C. for short and henceforth so referred to) seven years ago, is yet to be heard on the merits. It would not be surprising if it remains unheard for a further decade.
Whoever is not satisfied with the decision of this court in the instant appeal has a further right of appeal to the Supreme Court. It is only after the apex court’s decision that parties would settle down to the real issue in controversy between them! For now, the…
