Judgement

ADAMU, JCA (Delivering the Lead Judgment): The appellant herein was convicted by the High Court of Justice, Osun State (Falade J.) on 1/7/ 98 and sentenced to various terms of imprisonment. He was charged on an information with three counts of charges involving the theft of a Toyota Panel Van with registration No. OS 3333 KR and its component parts (i.e. its engine block and gear box). At the end of the trial, the appellant was found guilty on all the three charges and convicted accordingly. He was sentenced on each charge to a three-year term of imprisonment (IHL) without an option of fine. The sentences are to run concurrently. Being dissatisfied A with the judgment of the trial court, the appellant has appealed against it in this court. During the trial, the appellant made a no case submission which was overruled by the trial court whereupon he appealed to this court against the ruling of the said trial court refusing or overruling his no-case submission.
