BA'ABA, JCA (Delivering the Lead Judgment): This is an appeal against the ruling of the Ondo State High Court, holden at Akure, delivered on the 15th day of November, 1999. The facts of the case, leading to this appeal; are simple and not in dispute and they are as follows: The appellant was in 1997 appointed as Attorney-General and Commissioner of Justice, Ondo State by the regime of Navy Captain AnthonyOnyearugbulem (Rtd.). On 29th May, 1999, when the Military Government handed over to Civilian Administration, he ceased to be the Attorney-General and Commissioner of Justice. On or about the month of July 1999, the 6th respondent, the Governor of Ondo State inaugurated a Commission of inquiry on capital projects and contracts awarded in Ondo State. On 10th September, 1999, the appellant was by a witness summons dated 10/9/99 asked to give evidence on the returns rendered by the Ministry of Justice to the Commission.
