ONYEKACHI AJA OTISI, J.C.A. (Delivering the Leading Judgment): The Appellant lodged this appeal against the judgment of the National Industrial Court, sitting at Calabar Division, Coram Hon Justice O. A. Obaseki-Osaghae, J. delivered on June 13, 2014 in Suit No. NICN/CA/76/2013, wherein the reliefs sought by the Appellant, as claimant were dismissed with costs of ₦20,000.00.

The facts leading to this appeal, as discernible from the Record of Appeal are as follows: The Appellant was a Lecturer and an employee of the Respondent. Before his demotion by the Respondent on March 1, 2013, he was a Senior Lecturer who had applied for promotion to the position of Reader. His application was in response to a Memo was sent by the Registrar of the Respondent to all Deans of Faculties, Provosts, Directors of Institutes and Heads of Departments calling for Academic Staff who were due for promotion to submit their works and articles through their respective Heads of Departments for the purpose of the…
