Judgement

DAHIRU MUSDAPHER, C. J. N. (Delivering the Lead Ruling): Having regard to our decision in SC.360/2011 delivered this morning, the learned counsel for the respondents having nothing to urge in favour of the respondents, I do not think is necessary to call on the appellants' counsel to argue the appeal. Suffice it to say, that the appeal-is allowed, and the judgment of the courts below is set aside, the matter is returned to the tribunal to be heard on the merits. No order as to cost.
