MUKHTAR JCA (Delivering the Lead Judgment): This appeal challenges the judgment of the High Court of Kwara State, delivered by A.A. Adewara, J on 21 December 2011 in suit No. KWS/166/2008, dismissing the appellant’s claim against the respondents.

The appellants as plaintiffs took out a writ of summons and a statement of claim dated 21 October 2008 against the respondents as defendants jointly and severally, which was later amended by leave of court granted on 21 March 2011, claiming for the following reliefs:

A declaration that the undertaking extracted from the claimants to the effect that they will not contest for payment of the remaining portion of their entitlements was obtained by false representation, fraudulent, and therefore null and void and of no effect whatsoever. b.
