ADETOUN ALAWIYE V. HON. MINISTER OF THE FEDERAL CAPITAL TERRITORY & 2 ORS

MOORE ASEIMO ABRAHAM ADUMEIN, J.S.C. (DELIVERING THE LEADING JUDGMENT): The appellant was the plaintiff in Suit No: FCT/HC/CV/456/2010 which she instituted in the High Court of the Federal Capital Territory, holden at Maitama, Abuja. The appellant sought the following reliefs against the respondents, who were the defendants in the trial Court: - 

"a) A Declaration that the Plaintiff is entitled to the Statutory Right of Occupancy of Plot 856, measuring 2100.01 square meter's in Cadastral, Zone A04, Asokoro, Abuja. 

b) A Declaration that she is entitled as Allotee pursuant to the right of occupancy dated 13th January, 2006 to the unexpired residue of the terms of the grant of the statutory right of occupancy. 

c) A Declaration that any purported notice of re-instatement of right of occupancy to Mr. Sampson Adebisi Fasemre dated 10th December, 2009 by the Federal Capital Territory Administration is illegal, null and void and of no effect whatsoever by reason of the fact that no notice of r…
