CHUKWUMA-ENEH J.C.A. (Delivering the Leading Judgment): The appellant (otherwise, the petitioner before the Election Tribunal) and the 1st Respondent contested the National Assembly Election into the Federal House of Representatives for the seat for Ado/Okpokwu/Ogbadibo Federal Constituency held on 20/2/99 as candidates for All Peoples Party (i.e. APP) and Peoples Democratic Party (i.e. PDP) respectively. The election was conducted and supervised in accordance with the National Assembly (Basic Constitutional and Transitional Provisions) Decree No.5/1999 by the 2nd to 4th Respondents. The results of the election were declared by the 2nd Respondent whereby the 1st Respondent was returned with 48,279 votes defeating his opponent - the Appellant who scored 36,934 votes.
The Appellant being dissatisfied with the result of the election has challenged the entire exercise by a petition filed before the National Assembly Election Tribunal Benue Zone seeking the following reliefs:
