RULING ON SUMMARY JUDGMENT APPLICATION

The Plaintiff/Applicant by its Writ of Summons and a Statement of Claim dated 9th September 2024 is seeking the following reliefs against the Defendants:

1. An order for the recovery of the sum of One Hundred and Twenty-Six Million, Six Hundred and Ninety-Three Thousand, Six Hundred and Fifty-Seven United States Dollars and Fifty-Seven Cents (US$126,693,657.57) jointly and severally from the Defendants, being monies owed to the Plaintiff under the Contracts of Guarantee;

2. Interest on the outstanding sum of US$126,693,657.57 at the contractual rate of 13% per annum from 8th August 2024 till the date of final payment; and 

3. Cost of legal fees of Six Million, Three Hundred and Thirty-Four Thousand, Six Hundred and Eighty-Two United States Dollars and Eighty-Seven Cents (US$6,334,682.87) being fees incurred by the Plaintiff in instituting this action.
