SURVEYOR JONES ANTHONY V. SURVEYOR GENERAL OF OGUN STATE & SURVEYORS COUNCIL OF NIGERIA

AUGIE JCA (Delivering the Lead Judgment): The appellant as plaintiff instituted an action against the 1st respondent at the Abeokuta High Court of Ogun State, wherein he claimed as follows -

(1) A declaration that the defendant’s letter dated 26th March 1997, particularly paragraph 2 of the same, is in contravention of the provisions of Surveyors Registration Council of Nigeria Act (SURCON) Cap. 425 Laws of the Federation, 1990.

(2) A declaration that the said letter of 26th March, 1997 is in violation of the guidelines for the control of survey practice in Nigeria made by the Surveyors Council of Nigeria Act (SURCON) pursuant to the provisions of section 4(d) and (e) of Surveyors Registration Council of Nigeria Act, Cap. 425.

(3) An order restraining the defendant from continuing to implement or give effect to the contents of the said letter particularly paragraph 2 of the same.
