AMUA-SEKYI J.S.C.: The suit from which this appeal arises has all the characteristics of a chieftaincy dispute. In 1976 one Yaw Sah who as Kofi Asiedu II was the odikro of Suponso under the Akim Manso stool died, and Kwaku Akonnor, the first defendant, was enstooled in his place under the name Amoa Kwadwo. The enstoolment was challenged in the High Court, Koforidua which, presided over by Dove Ag. J. (as he then was), granted an order of certiorari to quash the enstoolment, and of prohibition directed to the Akim Kotoku Traditional Council against his recognition as a chief. The decision is said to be on appeal before this court.
Some fourteen months later the plaintiff, Kwame Gyamera, who was not a party to the proceedings before Dove Ag. J. (as he then was), issued this writ in the name of Baffour Kofi Asiedu III against Akonnor and others for a declaration of title to the Suponso lands, recovery of possession and an injunction.
