ATC TOWER (GHANA) LTD V. PPL NET GHANA LIMITED

RULING

[1] This ruling is in respect of a Motion on Notice to Strike out Writ of Summons filed by the Defendant/Applicant (hereinafter referred to as “The Applicant”). 

[2] The application is supported by a 17-paragraphed Affidavit dated 3rd April 2025. The relevant paragraphs of the Affidavit in Support deposed to by Prince Worlanyo Nortsu read as follows:

4. That by a Writ of Summons and Statement of Claim, the Plaintiff commenced the instant action for the reliefs endorsed on its writ of summons for orders against the defendant as follows;

   a. An order of Perpetual injunction to restrain the Defendant, their agents, servants, workmen and assigns and all those claiming through them from entering, operating from, transmitting radio signal, dealing with or in any way interfering with the Plaintiff’s sites covered under the Amended and Related Master Tower Space Use agreement dated 1st August 2018.

   b. Damages for trespass to the Plaintiff’s sites.
