YAKUBU JCA (Delivering the Lead Judgment): The plaintiffs/ appellants caused the issuance of an originating summons in suit No.TRSJ/ 5/2010 of 28 January 2010 against the defendants/respondents wherein, certain declarative and injunctive reliefs were claimed against the latter. The main contention of the plaintiffs who were the democratically elected chairman and councilors respectively of Wukari Local Government Council, of Taraba State was that section 118(c) of the Taraba State Local Government Law, No 2 of 2000 as amended by the Taraba State Local Government (Amendment) Law, No. 12 of 2009 is not in tandem with the provision of section 7(1) of the Constitution of the Federal Republic of Nigeria, 1999 because the said amendment of the Local Government Law, No. 12 of 2009 was targeted at a reduction of their tenure of office fromthree years to two years.
