OBIETONBARA OWUPELE DANIEL-KALIO, J.C.A. (Delivering the Leading Judgment): The Appeal here is against the judgment of the Federal High Court (the lower Court) of the Lagos Division delivered by M.S. Hassan, J on 13/5/2016. The Appellants (applicants at the lower Court) Chinedu Atuche, Fayemi Olaposi, Chika Augustine Onuchukwu, Ebun Ilori and Esther Enemuwe, took out an Originating Summons in which they sued the Respondents, Inspector General of Police and State Security Service, for the enforcement of their fundamental rights pursuant to Sections 34(1), 35(1), 41(1) and 46 of the Constitution of the Federal Republic of Nigeria, 1999 (as amended), Articles 5, 6 and 12(1) of the African Charter on Human and Peoples' Rights, Order 11 Rule 3 of the Fundamental Rights (Enforcement Procedure) Rules, 2009, and under the inherent jurisdiction of the Court.
