OBIETONBARA O. DANIEL-KALIO, J.C.A. (Delivering the Leading Judgment): This appeal is in respect of a land sale agreement. The 1st Respondent, Alhaji Aliko Mohammed OFR was the claimant at the High Court of Kaduna State. He had four plots of land at Angwan Gwari, directly behind the premises of Sterling Civil Engineering Company Ltd. The 1st Respondent decided to dispose of the four plots in order to raise additional funds for a bottled water project he was embarking on at Misau, Bauchi State. He therefore authorized the 2nd Respondent, a friend of over 40 years, to get a buyer for the four plots. He laid out his terms and conditions for selling the plots. This included a selling price of N18 million for the four plots. Soon enough, the 2nd Respondent informed the 1st Respondent that he had found a willing buyer who was prepared to pay the offered price of N18 million.
