(Delivering the Leading Judgment): This appeal is against the decision of the Taraba State High Court delivered on the 15th February, 2022 (hereinafter referred to as “the Court below”) wherein the learned trial Judge dismissed the Appellant’s case for want of proving identity of the land in dispute and refused all the reliefs sought by the Appellant who was the Plaintiff at the Court below. See pages 331-347 of the Records. In the suit filed on the 2nd August, 2016 commenced by a writ of summons, the Appellant claimed against the Respondents who were Defendants the following reliefs:

1. A declaration that the Plaintiff is the rightful owner and entitled to all that parcel of land with an area of about 6.165 Hectares lying and situate at Shazampa Mile-Six, bounded as follows:

a. To the North by a stream

b. To the South by the land of Taba Appa

c. To the West with the land of one Salau Kassong
