Judgement

UZO IFEYINWA NDUKWE-ANYANWU, J.C.A. (Delivering the Leading Judgment): This is an appeal against the Ruling of the High Court of Kano State delivered on the 11th May, 2017 by Hon. Justice Aisha R.D Muhammad.

The Appellant was arraigned before the lower Court on a one count charge for the offence of Obtaining by False Pretense contrary to the provision of Section 1(1)(a) of the Advance Fee Fraud and other Fraud Related Offences Act 2006 and punishable under Section 1(3) of the same Act.

The Appellant pleaded not guilty to the charge. On 13th March, 2017 an application for bail for the Appellant was brought before the lower Court. An affidavit was filed in support of the application. The Respondent filed a counter-affidavit and the Appellant filed a further and better affidavit. The lower Court heard arguments on the application for bail and in its ruling refused the Appellants bail application.

Dissatisfied with the refusal of his application for bail, the Appellant filed his appeal again…
