SIDDIOQ JAURO BAYO V. DON DAJ HALILU NJIDDA & ORS

SANUSI, JCA (Delivering the Lead Judgment): The appellant filed his petition before the National Assembly/Governorship and Legislative Houses Election Tribunal sitting in Yola, Adamawa State of Nigeria (hereinafter referred to as “the Tribunal”). The appellant was a candidate at the election into the seat of House of Assembly of Adamawa State and had contested the said election on the platform of the All Nigeria Peoples Party (ANPP). He contested against the 1st respondent/1st cross-appellant) Mr. Donaj Halilu Njidda, who was also sponsored to contest the said election by his political party the Peoples Democratic Party (PDP), which is also the 2nd respondent/2nd cross-appellant. The said election was held on the 3rd of May, 2003.

In the petition of the petitioner/appellant dated 2nd June, 2003 the following reliefs were sought by the petitioner/appellant, namely:-
