HABEEB ADEWALE OLUMUYIWA ABIRU, J.C.A. (Delivering the Leading Judgment): This appeal is against the judgment of the High Court of Kano State delivered in Suit No K/439/2005 by Honorable Justice Nuradeen S. Umar on the 3rd of December, 2012. The Appellants were the claimants in the lower Court and their claims against the Respondents, as first to fifth defendants, were for:
i. A declaration that the assignment of the property situate at Plot 87, Sani Mainagge Road, Kano covered by Certificate of Occupancy No LKN/RES/RC/82/1113 by the first Respondent in favour of the second Respondent is fraudulent, illegal and unlawful and null, void and of no effect whatsoever.
ii. A declaration that all transactions by the Respondents in respect of the property, subject matter of the suit, in flagrant disobedience of the subsisting judgment in Suit No K/134/91 and during the pendency of Suit No K/558/98 are null void and of no legal effect whatsoever.
