SANKEY JCA (Delivering the Lead Judgment): This is an appeal against thedecision of the Federal High Court, sitting in Yola delivered on 9

March 2006, wherein the trial court gave judgment in favour of the respondent, (as defendant), and against the appellant, (as plaintiff), before that court. The appellant had approached the lower court, via a writ of summons and statement of claim dated 8 December 2003, seeking the following reliefs: i. The sum of N105, 000.00 (one hundred and five thousand naira), only being the pension fund of the plaintiff;

. The sum of N48, 000.00 (forty eight thousand naira) only, being arrears of monthly pension for the period 3 September 2002, to 3 September 2003, at the rate of N4, 000.00 (four thousand naira) per month;

. The sum of N4, 000.00 (four thousand naira) per month as from 3 October 2003; 10% interest from 3 September 2002, to the date of judgment and thereafter to date of liquidation ; The cost of the suit.
