BULKACHUWA JCA (Delivering the Lead Judgment): By a writ of summons filed on 18 June 2004 before the High Court of Adamawa State , the appellant as plaintiff instituted the action giving rise to this appeal where in he claimed these reliefs; A declaration that the deposition of the HamaBachama, Freddy Soditi Bongo, by the Governor of Adamawa State which was made on 11 June 2004 vide the letter of the secretary to the State Government of Adamawa State with reference No. SGS 10 September, vol. 11/477 is altogether unconstitutional, irregular, invalid, null and void and of no effect whatsoever, the Governor of Adamawa State not having conducted a due inquiry and consultation with all the persons concerned in the selection of the Hama Bachama nor did the Governor receive the advice of the council of chiefs before he purported to depose the Hama Bachama.
