MISITURA OMODERE BOLAJI-YUSUFF, J.C.A.(Delivering the Leading Judgment): This is an appeal against the judgment of the Anambra State High Court delivered in suit no. OT/MISC.520/2012 on 6/6/2012 on an application made by the respondent for the enforcement of her fundamental right wherein she sought the following reliefs:
1. A declaration that consistent harassment, threat to arrest, detain, torture or deal with the applicant by the 1st respondent is likely to infringe the applicants right to dignity of human person, personal liberty and freedom of movement guaranteed under Sections 33, 34, 35 and 41 of the Constitution of the Federal Republic of Nigeria 1999 as amended.
2. A declaration that incessant phone calls of the applicant by the 1st respondent without disclosing his identity and with series of threats to deal with the applicant anywhere she is seen and inordinate demand of money from the applicant are likely to infringe on the applicants right to life, personal liberty and freed…
