ESSIEN J (DELIVERING THE RULING): This court had on the 7^th March, 2018 adjourned a motion on notice dated the 5^th March, 2018 and filed on 6^th March, 2018 for hearing on the 9^th April, 2018. The judgment creditor/respondent’s Counsel’s had filed an affidavit in opposition to the motion on notice and a written response or address in support of the counter affidavit on the 19^th March, 2018. The response of learned counsel for the judgment creditor/respondent to the motion was served on all the parties. When the motion which was ripe for hearing and which was the motion slated for hearing on the 9^th April, 2018 came up, the judgment debtor counsel refused to move the application citing the fact that he had filed another motion on the 6^th March, 2018. It is on record that the said motion was not before the court neither was any of the parties served with the said motion. Upon the refusal of the applicant counsel to move the motion or withdraw same, learned counsel for the judgment credit…
