The issue in this appeal is a very narrow one of whether the High Court exercised its discretion properly in refusing the appellant’s application for interlocutory injunction to restrain “the 1st defendant, his agents servants and assigns from putting up structures on the land in dispute pending the final determination of the suit herein and further order or orders as this Honourable Court may deem fit.”
The facts relevant to this case are that the plaintiff is a limited liability company registered under the laws of Ghana. The 1st defendant, Mr. Paul Amoo-Gottfried, is a Quantity Surveyor who lives at CFC Estates, Dome, Accra while the 2nd defendant is a statutory body which registers interests in land.
