Facts

According to the Appellant, in his brief of argument: 

"1.01 The Appellant was the Plaintiff at the Trial Madagali Area Court No. 2, Shuwa, of Adamawa State, where the Appellant sued the Respondent who was the Defendant, for Declaration of Title to Land, which he inherited same from his great grandfather - Audi. 

1.02 At the trial Area Court, both the Appellant and the Respondent called Three (3) Witnesses each respectively and the Trial Court made a visit to locus in quo during which the Appellant and his Witnesses were present as well as the Respondent who later on informed the trial Area Court that he is not going to listen to the Honorable Court which is found on Pages 33 to 34 of the Record of Appeal where the Court invoked Order 9, Rule 3 of the Trial Area Court. 1.03 The Trial Area Court entered Judgment in favor of the Appellant which can be found at Pages 34 to 37 of the Record of Appeal, and being dissa…
