Judgement

EJIWUNMI, J.S.C. (Delivering the Leading Judgment): The above named appellants were convicted for the offences of conspiracy and culpable homicide contrary to sections 97 and 221 (a) of the Penal Code respectively by Fati Abubakar, J. sitting at the Minna High Court, the state filed its information against them and eight others.

That information, which contained three counts read thus:

(12) Alhaji Muhammadu Anahiru (Etsu of Agaie (m) and

(13) Ndagi Mohammed Babadoko (m)

on or about the 9th to the 13th day of February, 1994, at Agaie in Agaie Local Government Area of Niger State agreed to do an illegal act, to wit; to cause the death…
