Judgement

HUSSEIN MUKHTAR J.C.A. (Delivering the Leading Judgment): This appeal emanates from the judgment of the High Court of Kwara State delivered by Hon. Justice S. D Kawu on 13th December 2012 of the Ilorin Judicial division convicting the appellant of the offence of extortion and sentencing him to a fine of One Hundred Thousand Naira (100,000.00) or One year imprisonment. (See pages 102 - 142 of the record of appeal). As a mark of being disgruntled with that judgment, the appellant filed a notice of appeal on 4th March, 2013 premised on the following five grounds:

GROUND ONE

The lower Court erred in law when it held that the Department of State Security Services properly investigated the case against the accused persons which it considers bordered on internal security.

GROUND TWO

The lower Court erred in law when it convicted the Appellant of the offence of extortion under the provision of Section 292 of the Penal Code which was not provided for under the Kwara State Prohibition of Kidnap…
