JUDGMENT

On 26 July, 2021 the Plaintiff instituted action against the Defendant seeking the following reliefs:
1. A declaration of title to all that piece and parcel of land situate, being and lying at Abrika Anaafo, Upper Inchaban in the Shama District of the Western Region and bounded on one side by Asamankoma family lands, on another side by Tando family lands and on the other side by the old Sekondi Cape Coast Motor Road and variously known as Abirika Anaafo lands and measuring an approximate area of 650 acres more or less.
2. A declaration that Defendant has no right to authorize or cause the burial of any deceased person on portions of Abirika Anaafo Lands described in paragraph 1 supra.
3. An order directed at Defendant to take legal steps to cause to be exhumed the remains of one Obapanyin Dorcas Eshun from the part of Abirika Anaafo Land where it was unlawfully buried.
