RULING

The issue raised for the consideration of this Court in this proceeding is whether the failure of a Plaintiff to state or indicate his residential or occupational address on a writ (and by extension, an accompanying statement of claim) renders the writ a nullity and thereby susceptible to be set aside.

In order to fully appreciate the issue raised, it is necessary to give a brief resume of the events culminating in the instant delivery.

On 8 July 2025, the Plaintiff, Ebusuapanyin Kwame Serebour, instituted the present legal action seeking a declaration from this Court that the Defendant, Seth Ayensu, is not the head of the Agona Royal family of Gomoa Ojobi, and thus, has no right to represent the said family. The Plaintiff further sought an order for perpetual injunction to restrain the Defendant, his agents, assigns, etc. from recognizing him as the head of the Agona Royal family of Gomoa Ojobi, among other ancillary reliefs.
