MOORE ASEIMO ABRAHAM ADUMEIN, J.C.A. (Delivering the Leading Judgment): The appellant and one Helen Ode (f) were arraigned in the Owan West Area Customary Court, Sabongidda-Ora, Edo State in Charge No. OW/ACCS/2C/94. The appellant was the 1st accused in the said charge where he and his co-accused were charged with the offences of conspiracy to obtain money under false pretences and unlawfully obtaining money (N28,500.00K) from one Prince Henry Oboh. At the close of trial, the appellant and his co-accused person were found guilty and convicted of the two offences of conspiracy and stealing on 30/06/1994. The appellant was sentenced to 3 years imprisonment with an option of N1,500.00 in respect of each count.
