EDWARD AMANDAH & SEYRAM KWAMI GORNI V. THE REPUBLIC

J U D G M E N T

OFOE, J.A:

The accused and one other who we will refer to as the 1A was convicted for defrauding by false pretences and sentenced to 8years imprisonment by the Circuit Court. On appeal to the High Court the sentence was reduced to 4 years. Since his expectation that the High Court will quash his sentence did not materialize he is before us still pressing for a favourable decision acquitting him of the charge levelled against him. The grievance he has against the unfavourable judgment of the trial court he has formulated under nine grounds of appeal which we quote as follows:

“i. The Honourable Court neglected or failed to take into consideration the confession statement of the first accused admitting the commission of the offence.

ii. The Honourable Court erred in affirming and or dismissing the appeal of the Convict/Appellant/Appellant despite the confession by first Accused.
