ONYEKACHI AJA OTISI, J.C.A. (Delivering the Leading Judgment): This interlocutory appeal was lodged against the ruling of the Federal High Court (the lower Court) Coram M.H. Kurya, J., sitting at its Lagos Judicial Division, delivered on May 6th, 2014, wherein the lower Court discountenanced the counter-affidavit and written address of the Appellant, as 1st Respondent, before the lower Court, filed in response to the originating motion filed by the 1st Respondent, as applicant before the lower Court, seeking redress for an alleged breach of his fundamental human rights.
