ABDULLAHI JCA (Delivering the Lead Judgment): This is an appeal against the decision of the Imo State High Court of Justice Owerri Judicial Division, Coram Onumajulu (J) delivered on the 19 February 2001. The present appellant asthe plaintiff at the lower court instituted an action against the present respondent as defendant, seeking for: A declaration that the defendant’s letterdated December 1998 (Ref. GA/CA/NAL) purportedly dismissing the plaintiff from its services with effect from 29 December 1996 is malicious, illegal, null and void and of no effect whatsoever in that it contravenes the plaintiff’s contract of employment and right to fair hearingguaranteed under the Constitution of the Federal Republic of Nigeria.

A declaration that the plaintiff is still in the employment of the defendant.

(c) An order of court compelling the defendant to pay to the plaintiff damages for wrongful dismissal in the sum of N10,000,000.00 (ten million naira).
